When you understand the legal standard, you can prepare with greater focus. The court’s compass is the child’s best interests.
The Child’s Best Interests Come First
Under RCW 26.09.002, Washington courts use the child’s best interests when allocating parental responsibilities. A parenting arrangement should support the child’s:
- Emotional growth
- Health
- Stability
- Physical care
- Safety
Courts generally seek to preserve meaningful parent-child relationships while protecting children from harm.
What the Court May Consider
Under RCW 26.09.187, the court may consider the child’s relationship with each parent, any parental agreements, each parent’s performance of parenting functions, and who has handled daily care.
The court may also consider the child’s emotional needs, developmental level, relationships with siblings and significant adults, school and community connections, the parents’ reasonable wishes, the wishes of a mature child, and each parent’s work schedule.
Show the Parenting Functions
Specific examples are stronger than statements such as, “I do everything.” Be ready to describe who provides:
- Food, clothing, hygiene, and supervision
- School support and transportation
- Medical and dental care
- Routines and boundaries
- Emotional support and protection from harm
A 50/50 schedule is not automatic. A parent seeking substantially equal time should present a workable, child-focused schedule that fits the child’s age, school, activities, travel, work schedules, communication needs, and safety.
“Primary residential placement” usually means more residential time with one parent. The focus remains on established routines, caregiving history, stable housing, transportation, developmental needs, support for the other parent’s relationship, and safety.
Decision-Making and Safety Limits
Under RCW 26.09.184 and RCW 26.09.187, a plan may address major decisions about education, health care, religion, and other important areas. Each parent generally handles ordinary day-to-day decisions during their residential time. Emergency health and safety decisions may require immediate action.
Under RCW 26.09.191, the court may limit residential time, decision-making, communication, exchanges, or contact because of domestic violence, abuse, neglect, impairment, abusive conflict, significant relationship loss, or other conduct affecting the child’s best interests.
RCW 26.09.192 addresses sexual-abuse and sex-offense concerns. Seek immediate advice from a Washington-licensed attorney if those issues, dependency, protection-order, criminal, or no-contact matters are involved.
Build an Organized Record
Declarations, calendars, communications, school and medical records, witnesses, professional or GAL information, police records, protection-order records, and litigation conduct may help. Specific, relevant, corroborated evidence is generally more useful than excessive accusations.
